The FCC has denied the appeal of CATHOLIC RADIO NETWORK OF LOVELAND, INC. of a $3,200 fine for operating Religion KPIO-A/LOVELAND-FORT COLLINS-GREELEY, CO at power levels above its authorized parameters.
The licensee asserted that the violation was not willful since its employees did not realize the station was at an unauthorized power level, but the Commission said it considers operation of the station evidence of willfulness even if the staff is unaware of the unauthorized transmissions, and also rejected the argument that fines should be waived against non-profit entities who make good faith remedial efforts.
