Notice of Violation issued for violation(s) noted herein
1. This is a Notice of Violation (Notice) issued pursuant to Section 1.89 of the
Commission’s rules (Rules),1
to Spanish Media Consulting Corporation (SMCC), licensee of AM
broadcast station KVAM, serving Loveland, Colorado. Pursuant to Section 1.89(a) of the Rules, issuance
of this Notice does not preclude the Enforcement Bureau from further action if warranted, including
issuing a Notice of Apparent Liability for Forfeiture for the violation noted herein.2
2. On April 5, 2018, during an inspection of the transmitter site, Agents of the Enforcement
Bureau’s Denver Office observed the following violation:
a. 47 C.F.R. § 73.49: “AM Transmission system fencing requirements. Antenna towers
having radio frequency potential at the base (series fed, folded unipole, and insulated
base antennas) must be enclosed within effective locked fences or other enclosures.”
At the time of the inspection, the Agents observed that the KVAM tower had no base
fence or other enclosure.
