View Full Version : FCC Fines TBS, Kentucky TV Station For EAS Tone Simulation In Commercials

The FCC has proposed a fine against a cable network and reached a consent decree with a television station for simulating Emergency Alert System tones in commercials. TURNER BROADCASTING SYSTEM is facing a $25,000 fine for a "CONAN" promo on TBS that used a simulation of the EAS tones, while MAX MEDIA's MMK LICENSE LLC will pay a "voluntary contribution" of $39,000 for a spot for the "FAN WEAR AND MORE STORE" on NBC and CBS affiliate WNKY-DT/BOWLING GREEN, KY.

Enforcement Bureau Acting Chief ROBERT H. RATCLIFFE said, “Today’s enforcement action sends a strong message: the FCC will not tolerate misuse or abuse of the Emergency Alert System. It is inexcusable to trivialize the sounds specifically used to notify viewers of the dangers of an incoming tornado or to alert them to be on the lookout for a kidnapped child, merely to advertise a talk show or a clothing store. This activity not only undermines the very purpose of a unique set of emergency alert signals, but is a clear violation of the law.”
