View Full Version : Photo Agency Sues Clear Channel For Photos On Their Websites - Including KPTT 95.7 FM

NATIONAL PHOTO GROUP LLC, a photo agency, is suing CLEAR CHANNEL for unauthorized use of celebrity photos on radio station websites.

The suit names 11 CLEAR CHANNEL stations --

Top 40 WRVW (107.5 THE RIVER)/NASHVILLE, Country WUSY (US 101)/CHATTANOOGA, Top 40 KZHT (97.1 ZHT)/SALT LAKE CITY, Top 40 KHFI (96.7 KISS FM)/AUSTIN, Top 40/Rhythmic WSNX/GRAND RAPIDS, Top 40 WVKS (92.5 KISS FM)/TOLEDO, Top 40/Rhythmic KPTT (95.7 THE PARTY)/DENVER, Country WUBL (94.9 THE BULL)/ATLANTA, Top 40 KZCH (CHANNEL 963)/WICHITA, Hot AC KPEK (100.3 THE PEAK)/ALBUQUERQUE, and Country WYYD/ROANOKE -- and alleges that the stations "copied, modified, and displayed NPG's photographs" "knowingly and in violation of the UNITED STATES copyright laws."

Pictures used include shots of JASON ALDEAN and BRITTANY KERR, ASHTON KUTCHER and DEMI MOORE, DREW BARRYMORE, DEMI MOORE solo, LIBERTY ROSS, and PRINCE HARRY.

The suit, filed in U.S. District Court for the Western District of TEXAS, seeks statutory damages of $150,000 per infringement or actual damages and wrongful profits, plus attorney's fees and other relief.
